In 2005 Bell Davies won a landmark case at the European Court of Justice (ECJ)

We have secured a judgement from the ECJ which means that an importer can apply for duty repayment and oblige Customs to reject the request for repayment by way of a reasoned decision or undertake a review concerning the revision sought. In the case of duty paid in error on buying commission then the duty must be repaid.

It follows that duty paid on buying commission can never properly be retained because it is not part of the price paid or payable for the goods nor is it a dutiable addition to the price paid or payable. More
